Foreign Worker Rehiring (Transfer Owner Program) in Malaysia

First and foremost, foreign worker rehiring is not PATI legalization. Actually, it’s an owner transfer program for foreign workers and the program is called Rehiring under JTKSM.  This program was launched since Jun-2020 with new guidelines. 

1. Who is allowed to transfer foreign workers? If a company face downsizing or restructuring, they can transfer existing foreign workers to others with consent from workers.  

2. Can existing company claim the balance levy of the working visa? No, the balance levy will be forfeited and new owner need to pay levy and other expenses  liked hiring a new foreign worker. 

3. How long it take to transfer the owner? Before you start, the foreign workers must have working visa validity of at least 3 months. Off-course, its advisable to process earlier to prevent unforeseen situation. Remember that you can’t claim the balance levy of the working visa. 

4. Who is allowed to accept the foreign workers? New  owner must be a qualified company to get approval from OSC, KDN for the owner transfer program. The interview process at OSC, KDN is same as hiring foreign workers from source country. 

5. Will existing company be blacklisted from taking new foreign workers in future? Existing company need to get supporting letter from JTKSM for releasing  the foreign workers. So, existing company wouldn’t be blacklisted by OSC, KDN unless it suspect to be illegal or unethical activities.
