Right Steps To Hire Foreign Workers In Malaysia

Here are the right steps to hire foreign workers from source country. Hence, your workers will reach Malaysia legally if you follow the given steps. 

  1.  Apply 1st approval from JTKSMGenerally, this is the step which consume time (around 1 month) because JTKSM will audit your application profile and also inspect your working site and hostel. Click here to know how in getting approval in shortest time. 
  2. Apply final approval from OSC,KDN. Once you get the 1st (first) approval from JTKSM, you can arrange 2nd (second) interview at OSC, KDN. Normally, you will get the final approval letter on the same day if they don’t request addition documents other than the application profile. 
  3. Collect bios from recruitment agency. To select a matched candidate, make sure your demand letter (job vacancy) is completed with job description, working site photo/video and etc. to prevent argument which might happened. Despite that,  collecting complete bios for calling visa application could more than 1 month if the candidates passport, medical report, etc.  are not complete.   4. Apply approval from labour attaché at source country . Different nation of labour attaché has different steps to get the approval (around 2 weeks). Thus, make sure you do it right before/after submitting calling visa application. 
  5.  Apply calling visa at Immigration Malaysia. You should able to select the candidates from FWCMS ( Foreign Workers Centralized Management System) if the bios are complete. Then, you will be provided a reference code to purchase insurance for the calling visa application. Once its done, you can collect calling visa at Immigration Malaysia within 2 weeks. 
  6. Apply single entry visa at Malaysia Embassy. This is the last step. Therefore, overseas recruiters will submit single entry visa application at Malaysia embassy with the calling visa & labour attaché’s approval and workers will depart from source country after attending orientation (around 1 month). 
  7. Apply PLKS at Immigration Malaysia. Once the workers reach Malaysia, you have 30 days to apply PLKS for the workers at Immigration Malaysia. So, the first thing to do is arrange them for medical test at FOMEMA panel clinic. In that case, you have buffer time to appeal if the medical test result is fail. 
  8. Report to JTKSM & LHDN. Finally, your workers are legal to work in Malaysia. But, your job is yet finished. Do remember to notify JTKSM and LHDN to prevent penalty by them. Click here to know how in notifying JTKSM and LHDN.  

As a summary, it take around 3 to 4 months for the hiring foreign workers from source country. Therefore, you need to plan earlier (at least 6 months) if your existing workers contract is going to be expired or you need extra workers.
